Ban on Punjab government's land pooling policy: High Court seeks reply in 4 weeks;
Today, on 7th August, the Punjab and Haryana High Court heard the land pooling policy of the Punjab government for the second consecutive day. The court has stayed the policy. The Punjab government has been asked to file a reply in 4 weeks. The court's orders will be issued soon. After that the whole situation will be clear.
Petitioner's lawyer Charanpal Singh Bagdi gave this information to the media outside the court. This PIL was filed by a person living in Ludhiana through his advocate.
The case of 1947 partition was also raised in the court
The lawyers said that they put forward many arguments in the court. The farmers said that when the country was divided in 1947, the farmers had suffered even then. Nothing has happened to them till now. Some people have not yet got plots in the land pooling policy in Mohali. The court asked that when 65 thousand acres of land will be taken under land pooling, what will happen to the grains grown there? And what will be the future of the farm laborers working there?
The government's lawyers also argued in their favor. On this, the court said that the government has two options—either it withdraws this policy, or the court will cancel it. However, the government lawyers said that they will discuss the matter with the government and file an appropriate reply. Finally, the court gave the government four weeks to file a reply.
The court raised two questions on the policy
During the hearing, the court raised two important questions. The first question was whether an environmental assessment study has been done for this policy. The second question was what are the provisions for the rehabilitation of landless laborers and other people dependent on land.
On this, Advocate General Maninder Singh Grewal sought time from the court to file a reply and said that this policy will remain suspended till August 7 and no further step will be taken till then.
The court also said that in the case "Resident Welfare Association vs Chandigarh Administration" it has been made clear that environmental impact assessment is necessary before granting permission for urban development. The Punjab government had also made some amendments in the land pooling policy. Which was said to be in the interest of farmers.
A person from Ludhiana had challenged the government
This petition was filed in the High Court by Ludhiana resident Advocate Gurdeep Singh. He himself is a farmer and his own land was coming under this policy. In such a situation, he challenged the land pooling policy on behalf of farmers and land owners.
His argument was that clear rules have been laid down by the central government regarding land acquisition and the state government cannot change these central rules at its own will. The High Court had accepted his petition
The government will give one lakh rupees until the possession of the plot is given
In the cabinet meeting of the Punjab government held on July 22, the land pooling policy was amended. According to this, the government will give 1 lakh rupees annually to the farmers in lieu of land in land pooling until the possession of the plot is given to them. If there is a delay in this, then this amount will be increased by 10 percent every year. At the same time, till the area is not developed, the farmers will be able to cultivate on it.

CM said that we have made a plan for those farmers whose land is to be acquired which is less than one acre. They will be given plots for that. If a person does not want to take a commercial plot, then his residential area will be increased. Under the scheme, farmers will be given land in exchange for land.
