In a significant development in the 2013 sexual assault case, the Supreme Court of India directed former Tehelka Editor-in-Chief Tarun Tejpal to surrender within two weeks. A single-judge bench presided over by Justice Alok Aradhe ruled that Tejpal must surrender to jail authorities and submit his surrender certificate before his appeal challenging his conviction is taken up for consideration on September 22, 2026.
Supreme Court Mandates Surrender First
The apex court rejected Tejpal's plea seeking exemption from surrendering. Senior Advocate Kapil Sibal, representing Tejpal, argued that his client had been out on bail for most of the 13-year period since the incident and requested that the court hear the appeal without requiring immediate incarceration.
However, Solicitor General Tushar Mehta, appearing for the State of Goa, strongly opposed the exemption, contending that the legal protocol requires a convicted individual to surrender before their appeal against conviction can be listed on merits. The Supreme Court emphasized that it must evaluate the gravity of the offence and the nature of the 10-year sentence before considering any leniency.
Reversal of Trial Court Verdict by Bombay High Court
The Supreme Court's direction comes shortly after the Goa Bench of the Bombay High Court overturned Tejpal's acquittal on August 6, 2026. The High Court found him guilty under relevant provisions of the Indian Penal Code—including rape, sexual harassment, and assault with intent to disrobe—and sentenced him to 10 years of rigorous imprisonment along with a fine exceeding ₹10 lakh.
The High Court had previously granted Tejpal a temporary four-week window to surrender, which prompted his legal team to approach the Supreme Court. Simultaneously, the Goa state government has also filed a petition in the Supreme Court seeking an enhancement of Tejpal’s sentence from 10 years to life imprisonment, arguing that the severity of the crime warrants the maximum statutory punishment.
